France’s highest administrative court has confirmed a lower court’s ruling that the burkini may not be worn in public pools in Grenoble, in a decision deemed by the Minister of the Interior as a ” great victory for secularism”.
“The new procedural rules for public swimming pools in Grenoble … affect the proper functioning of the public service and undermine the equal treatment of users, endangering the impartiality of the public service,” the State Council said in a statement.
Grenoble city council voted to allow the use of the burkini on May 16, prompting protests from conservative and far-right politicians. The city’s action was appealed by the government, and a lower administrative court suspended the measure. Grenoble responded with a legal appeal to the Council of State.
The Council of State said Grenoble’s relaxation of the rules came in response to calls from Muslims with the aim of satisfying religious demands, noting that it had thus “violated” the equal treatment of users of swimming facilities.
After the State Council’s decision, Interior Minister Gerald Darmanan said that the action taken by Grenoble was “finally rescinded”, he added: “This is a victory for the anti Separatist Tendencies’ Act, for secularism and above all for the Republic.”
